Is An Employee Background Check Report Really Necessary?

According to research, 5% of job applicants have a criminal record from the last seven years. Because of this, and in light of the increasingly sensitive nature of company security, more employers are choosing to implement regular employee background checks for all potential new hires. In addition, some companies have begun to require employee background checks for those employees being considered for promotion.

Any employee background checks which have the potential to impact hiring decisions are regulated by Equal Employment Opportunity (EEO) laws as well as the federal Fair Credit Reporting Act (FCRA). Employers need to understand their legal obligations when utilizing employee background checks. Developing a Compliant Employee Background Check Policy

  • A disclosure document outlining the employee background check policy to potential employees. Also include notification that all prospective employees will be asked to sign a release form authorizing the company to run employee background check report. Clearly indicate that any refusal to sign this release form will cause the applicant to no longer be considered for employment.

Let prospective employees know that a determination will be made on a case-by-case basis regarding whether or not discovery of a criminal conviction will be a negative factor in consideration for employment.

  • Point out that any applicant who provides misleading or intentionally deceptive information on their employment form or resume will no longer be considered for employment.

  • Keep in mind that "blanket policies" (policies which state that applicants whose employee background check returns a record of arrest or conviction of a crime will no longer be considered for employment) are not allowed by the EEOC.

  • When requesting information concerning arrest or convictions on your company's application form, include a statement of company policy regarding the use of such information. Let prospective employees know that employee background checks are just one part of a comprehensive review of an applicant's qualifications. Employee background checks alone will not cause applicants to be denied jobs unless the company determines the offense warrants such action.

Developing compliant employee background check policies that abide by all state and federal laws is key to protecting your organization and to ensuring fair and consistent application of employee background check procedures. Bear in mind that all hiring decisions in which an employee background check has been a negative factor in the hiring process should be referred to a qualified human resource professional who understands EEO and state regulations.
